General Terms and Conditions (GTC)
1. Scope of Application
These General Terms and Conditions apply to all orders placed by consumers via the online shop of
Gabriel Janik
Insterburger Str. 5
53117 Bonn
Germany
E-mail: zapfzeichen@gmail.com
Phone: 01631862202
hereinafter referred to as the "Seller".
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither attributable to their commercial nor their independent professional activity.
The online shop's offer is directed exclusively at consumers with a delivery address in Germany.
2. Contractual Partner and Conclusion of Contract
The purchase contract is concluded with
Gabriel Janik
Insterburger Str. 5
53117 Bonn
Germany
The presentation of products in the online shop does not generally constitute a legally binding offer, but rather an invitation to place an order.
The customer can select the desired products and add them to the shopping cart. Before completing the order, the customer can check and, if necessary, correct their entries.
By clicking the button to complete the order with an obligation to pay, the customer submits a binding offer to conclude a purchase contract for the goods in the shopping cart.
The contract is concluded as soon as the Seller explicitly accepts the order or ships the goods. An automatically sent confirmation of the receipt of the order only constitutes acceptance if it is clearly stated in its content.
3. Contract Language
The language available for the conclusion of the contract is German.
4. Products and Print-on-Demand
The Seller offers in particular textiles, accessories, and decorative items.
Some or all products are manufactured using the print-on-demand process. Production therefore generally only takes place after receipt of an order.
The products offered are designed by the Seller. The customer does not perform any individual personalization of the products.
Production after receipt of an order therefore does not in itself lead to the exclusion of an existing statutory right of withdrawal.
5. Prices and Shipping Costs
All prices stated in the online shop are final prices.
Due to the application of the small business regulation pursuant to § 19 UStG (German Value Added Tax Act), no VAT is charged.
In addition to the stated product price, shipping costs may apply. The applicable shipping costs will be displayed to the customer in the ordering process before completing the order.
Shipping within Germany depends on the order and the selected or available shipping rate at the shipping costs stated in the checkout.
6. Terms of Payment
Depending on availability in the checkout, the following payment methods are available in the online shop in particular:
-
Credit card
-
PayPal
-
Klarna
-
Sofortüberweisung (instant bank transfer) or corresponding payment methods offered by Klarna or Shopify
-
Shopify Payments
The actually available payment methods are displayed to the customer during the ordering process.
For individual payment methods, the business and payment terms of the respective payment service provider may additionally apply.
7. Production, Delivery and Shipping
The products are produced after receipt of an order. The usual production time is approx. 2–3 business days.
Subsequently, shipping takes place. The usual delivery time is a total of approx. 3–7 business days, depending on the production and shipping process, unless otherwise stated on the respective product page or in the ordering process.
Delivery is exclusively within Germany.
Production and shipping may be carried out by a print-on-demand service provider commissioned by the Seller in Germany. DHL, in particular, is used as a shipping service provider.
Should any unforeseen delivery delays occur, the customer will be informed as far as possible.
8. Retention of Title
The delivered goods remain the property of the Seller until full payment has been made.
9. Statutory Warranty Rights
Statutory warranty rights apply.
If a product is damaged, defective, or incorrectly delivered, the customer is asked to contact the Seller as soon as possible at
This request does not limit the customer's statutory rights.
10. Returns
When exercising the statutory right of withdrawal, the customer bears the direct costs of the return.
Returns should be sent to the following address:
Gabriel Janik
Insterburger Str. 5
53117 Bonn
Germany
The customer is requested to return the goods as complete as possible and in a condition that does not go beyond what is necessary to check the nature, characteristics, and functioning of the goods.
The customer's statutory rights are not limited by this request.
11. Liability
The Seller is liable without limitation for damages resulting from injury to life, body, or health based on an intentional or negligent breach of duty by the Seller or his vicarious agents.
For other damages, the Seller is liable without limitation in cases of intent and gross negligence.
In the event of a slightly negligent breach of essential contractual obligations, liability – as far as legally permissible – is limited to the foreseeable damage typical of the contract.
Mandatory statutory liability provisions, in particular under the Product Liability Act, remain unaffected.
12. Consumer Dispute Resolution
The Seller is not obliged and generally not prepared to participate in a dispute resolution procedure before a consumer arbitration board.
13. Final Provisions
The law of the Federal Republic of Germany applies, excluding the UN Sales Convention.
With respect to consumers, this choice of law applies only to the extent that the protection granted by mandatory provisions of the law of the state in which they have their habitual residence is not withdrawn.
